{"id":48128,"date":"2024-07-17T07:58:03","date_gmt":"2024-07-17T10:58:03","guid":{"rendered":"https:\/\/www.chmafm.com\/welcome\/?p=48128"},"modified":"2024-07-17T10:59:27","modified_gmt":"2024-07-17T13:59:27","slug":"councillor-says-elected-decs-help-keep-party-politics-out-of-education-defends-legal-spending","status":"publish","type":"post","link":"https:\/\/www.chmafm.com\/welcome\/councillor-says-elected-decs-help-keep-party-politics-out-of-education-defends-legal-spending\/","title":{"rendered":"Councillor says elected DECs help keep party politics out of education, defends legal spending"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A battle over policies meant to protect the rights of trans kids in the New Brunswick public school system extended into the courts earlier this year, with two Charter challenges against the provincial government\u2019s changes to Policy 713: one led by the Canadian Civil Liberties Association, and one by the Anglophone East District Education Council (DEC).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now a new court battle has begun with its roots in the Policy 713 controversy: Minister of Education Bill Hogan is taking the Anglophone East DEC to court to seek its dissolution. That means the Tantramar family of schools could find itself under the direct leadership of the province, instead of an elected council.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to a<a href=\"https:\/\/www.cbc.ca\/news\/canada\/new-brunswick\/anglophone-east-dec-hearing-1.7264900\"> report by CBC\u2019s Shane Magee<\/a>, the case for the dissolution of the DEC will be heard by Moncton\u2019s Court of King\u2019s Bench on November 14, nearly a month after a provincial election slated for October 21.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CHMA spoke with Anglophone East DEC councillor Kristin Cavoukian last week to learn more about the council\u2019s position in both its case against the province, and the provincial case against the DEC. We started off asking Cavoukian about a recent DEC decision to pursue an appeal of Judge Tracey DeWare\u2019s decision to deny the council legal standing in its Policy 713 case.<\/p>\n\n\n\n<figure class=\"wp-block-audio\"><audio controls src=\"https:\/\/www.chmafm.com\/welcome\/wp-content\/uploads\/2024\/07\/Cavoukian-edit-July-10-2024.mp3\"><\/audio><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cOur lawyers believe that some errors were made,\u201d says Cavoukian, \u201cand that an appeal is a worthwhile thing to do. Photo: Ivan Rosenberg<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Cavoukian points to DeWare\u2019s written decision which found the DEC did not have legal standing to pursue its case. \u201cI would say it comes across as semi-favourable to the argument we were making,\u201d says Cavoukian, \u201cif not outright favourable to it.\u201d Cavoukian says the council didn\u2019t get the sense that their suit was \u201ca lost cause\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cTo have a suit thrown out based on standing is losing on a technicality,\u201d says Cavoukian. \u201cSo the decision was taken right away that we would be appealing.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Concerns over legal spending &#8216;disingenuous&#8217; <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Education Minister Bill Hogan has long criticized the DEC for its spending on the Policy 713 case. In December last year, Hogan denied the DEC\u2019s request for funding to cover legal fees for its case against the province, going so far as to change the department\u2019s policy on how DECs can access funding to cover legal fees. In a letter on July 8, Hogan says that just over $400,000 in legal fees were \u201cmisappropriated\u201d and \u201cwasted\u201d by the Anglophone East DEC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI understand concerns about expenses,\u201d says Cavoukian, \u201cbut in this case, I believe that these concerns are being raised in a disingenuous way.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cavoukian says that the money spent so far on legal fees is a small percentage (less than 0.2%) of the DEC\u2019s annual $231 million budget. \u201cWe&#8217;re not talking about enormous sums of money that are being diverted,\u201d says Cavoukian.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She also says that the legal fees fall under a significant portion of the DEC\u2019s budget which goes to things other than direct classroom learning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe idea that that some classroom is going without books, or some teacher hasn&#8217;t been hired,\u201d says Cavoukian. \u201cI mean, these are just ridiculous claims to be making, and there&#8217;s simply no grounds for them.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cavoukian again points to Judge Tracey DeWare\u2019s written decision on the DEC\u2019s legal standing to sue over Policy 713, which rules out the relevance of the province\u2019s concerns over the DEC\u2019s spending on legal fees. \u201cI think the way she phrased it was, \u2018democracy is messy and expensive,\u2019\u201d says Cavoukian.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">DECs are &#8216;crucial&#8217;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Cavoukian also says she believes local governance is important to New Brunswickers. \u201cI\u2019m not sure what the point would be of having a District Education Council that&#8217;s elected by the citizens who live in that district,\u201d says Cavoukian, \u201cif their decisions could simply be overridden at all points in time by the Minister.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She points to a bill introduced by Minister Hogan in May of last year to change Anglophone DECs to simply advisory bodies, with no actual authority. The changes would have applied only to Anglophone DECs, and left Francophone DECs as they are.
